After receiving the indictment from Changsha Metinfo, we attached great importance to it and comprehensively revised the website immediately to ensure the compliance of its operation. At present, all functions of the website are operating normally.
It is particularly important to explain to you that the relevant behaviors of Changsha Metinfo have been characterized as “fishing for rights protection” by the Supreme People’s Court of the People’s Republic of China. The company has acted outrageously, initiating lawsuits against tens of thousands of units across the country, including hospitals, schools, scenic spots, various associations and non-profit organizations, with an extremely wide range of impact. The websites of these institutions, which were originally used to serve patients, display teaching achievements, assist local tourism, promote industry development and carry out public welfare activities, have all been involved in its litigation disputes.
Under the pretext of safeguarding rights, Changsha Metinfo advertised its software as “free and open-source” on its official website to induce enterprises to use it. However, after enterprises started using the software, it initiated large-scale litigations by conducting mass online evidence collection, on the ground that the copyright notice and website links were not retained in accordance with the “End-User License Agreement”. The wide scope and large number of its litigations have seriously disrupted the market order and brought great troubles and economic burdens to many enterprises and institutions. Such acts of abusing litigation rights in an improper way to seek improper interests not only violate the principle of business integrity but also receive negative legal evaluations.
As for the case between our company and this company, it is currently in the retrial review stage of the Supreme People’s Court of the People’s Republic of China. We firmly believe that the law will render a fair judgment to safeguard the legitimate rights and interests of market entities.
